To the maximum extent permitted by applicable law, neXus Hairpin™ LLC (operating as Xpiert Systems™), its engineers, and affiliates shall not be liable for any indirect, incidental, special, or punitive damages, including but not limited to loss of profits, data, or property damage resulting from the use or assembly of our modular systems or professional consulting services.

Assumption of Risk: The user acknowledges that specialized engineering hardware, specifically XFS (Xpiert Foundation Systems) load-bearing structures and XTP (Xpiert Target Practice) precision ballistic scoring systems, involve inherent mechanical and operational risks. By utilizing Xpiert Systems™ components, you voluntarily assume all risks associated with high-force feedback, structural loads, or live-fire environments.

Installation & Technical Responsibility: neXus Hairpin™ LLC provides technical architecture and guidance, but final structural and system integrity is dependent on user assembly and contractor execution. We are not liable for damages caused by:

• Improper torque application on MECH-LOCK™ or structural fasteners.
• Modifications to aluminum profiles or engineered plans (drilling, cutting, or altering) that compromise material temper or design intent.
• Failure to adhere to XFS sub-grade compaction, Michigan clay load distribution, or drainage specifications.
• Misuse of XTP electronic marking hardware in non-certified or unsafe environments.
• Use of non-standard or third-party hardware not officially certified for Xpiert integration.

Indemnification: You agree to indemnify and hold harmless neXus Hairpin™ LLC and its divisions from any claims, losses, or expenses (including legal fees) arising from your breach of these terms, your misuse of the equipment, or your violation of any third-party rights during operation.

Force Majeure: We shall not be responsible for delays or failures in performance resulting from causes beyond our reasonable control, including supply chain disruptions affecting aerospace-grade materials or global shipping logistics.

At Xpiert Systems™, we respect your privacy. We collect only the information necessary to process your orders, manage engineering consultations via XTC, and provide technical support. Your data is never sold to third parties.

neXus Hairpin™ LLC is dedicated to protecting your Personally Identifiable Information (PII). By engaging with our site or divisions (XFS, XWD, XTP, XPH, XTC), you consent to the collection and use of data as outlined in this policy to enhance your engineering and digital experience.

1. Legal Entity & DBAs

This platform is managed by neXus Hairpin LLC. The following divisions operate as "Doing Business As" (DBA) entities under neXus Hairpin LLC and are fully bound by these Terms:

• XFS (Xpiert Foundation Systems)
• XWD (Xpiert Web Designs)
• XTP (Xpiert Target Practice)
• XPH (Xpiert Patent Help)
• XTC (Xpiert Technical Consultants)

2. Engineering & Store Terms

By agreeing to these Terms, you confirm you have reached the age of majority. You may not utilize our modular components or consulting outputs for any unauthorized or illegal applications. Any digital breach, including the transmission of malware to XWD managed platforms, will result in immediate termination of Service.

3. Data Accuracy & Technical Information

Technical materials are provided for general reference; primary engineering sources (including PE-stamped drawings where applicable) should be consulted via XTC for critical structural decisions. Prices for hardware and consulting rates are subject to adjustment without prior notice.

4. Limitations of Engineering Warranty

You expressly agree that your use of the Service is at your sole risk. All hardware and consulting outputs are provided 'as is' and 'as available', without any implied warranties of merchantability or fitness for a specific application, except where explicitly stated.

5. Governing Law

These Terms of Service and any separate agreements for hardware or consulting shall be governed by and construed in accordance with the laws of the State of Michigan, United States.

Return Policy: Unused products in mint condition may be returned within thirty (30) days of delivery at the Customer’s expense. Custom-cut aluminum, site-specific XFS engineering plans, and XWD digital assets are non-returnable due to their specialized nature.

Manufacturing Guarantee: We guarantee that all Xpiert Systems™ hardware products are free from manufacturing defects for a period of twenty-four (24) months from the date of shipment.

Note on Material Standards: As we utilize aerospace-grade 6061-T6 aluminum, minor surface marks or light abrasions inherent to the extrusion process are not categorized as mechanical defects.

Engineering and field testing involve physical activity and mechanical forces. neXus Hairpin™ LLC is not responsible for injuries resulting from improper assembly or use of high-load structural components or ballistic tracking hardware. Ensure all MECH-LOCK™ components are tightened to spec before use.

We stand by our engineering. All specialized structural frames carry a limited lifetime warranty against manufacturing defects. Moving parts, electronic sensors, and XTP accessories are covered for 2 years. Our commitment is to deliver precision that lasts.
